These Terms & Conditions govern your use of matenearby.com operated by MateNearby.Com (the “Service”). Please read them carefully. By creating an account or using the Service you agree to be bound by them.
1. Eligibility
You must be at least 18 years old and legally able to enter into a contract. You must give accurate information and keep it up to date. One person may hold one account.
2. What MateNearby.Com is
MateNearby.Com is an online platform that lets verified customers and verified partners find and talk to each other 1-to-1. We are an intermediary. We do not employ partners, we are not a party to any arrangement you make with another member, and we do not guarantee any outcome.
Services listed on the platform are non-clinical and non-emergency. Nothing on the platform is medical, psychological, legal or financial advice.
3. Accounts and verification
- You must verify your email address. Partners must also complete KYC and be approved by our team before their profile goes live.
- We may approve, reject, suspend or ban an account at our discretion, for example for false information, failed verification or breach of these Terms.
- You are responsible for everything done through your account. Keep your password secret and tell us at once if you suspect misuse.
4. Plans, credits and payments
- Access is by paid subscription plan for a fixed period. Prices are shown before you pay, in the currency offered at checkout.
- Customer plans include connection credits (or unlimited requests on some plans). A credit is used when you send a request and is returned if the partner declines or the request expires.
- Partner plans keep a partner’s profile live and visible for the plan period.
- Payments are processed by third-party gateways. You agree to their terms. A plan is activated only after the gateway confirms your payment.
- Plans are prepaid and do not renew automatically. See the Refund & Cancellation Policy.
5. Your conduct
You agree to follow our Community Guidelines. In particular you must not:
- harass, threaten, abuse, stalk or discriminate against anyone;
- send sexual content or use the Service to solicit or offer sexual services;
- pretend to be someone else, or submit forged or another person’s documents;
- use the Service for anything unlawful, deceptive or unsafe;
- share other people’s private information without consent;
- send spam, advertising, malware or links designed to defraud;
- try to bypass security, scrape data or interfere with the Service.
6. Your content
You keep ownership of the text, photos and videos you post. You give us a limited, non-exclusive licence to host, display and transmit them as needed to run the Service. You promise you have the right to post them and that they do not break the law or anyone’s rights. Public reviews may stay visible after your account is closed in anonymised form.
7. Meeting and dealing with other members
You alone decide whether to talk to, meet or work with another member. Take sensible precautions: meet in public places, tell someone you trust, and never send money, OTPs or passwords. We do not verify the quality of anyone’s advice or services and are not responsible for what members say or do.
8. Reports, warnings and enforcement
Members can report conduct. We review reports and may warn, suspend or ban accounts, remove content, or share information with authorities when required by law. Decisions are made at our reasonable discretion.
9. Availability and changes
We work to keep the Service available but do not promise it will be uninterrupted or error-free. We may change or discontinue features, and may update these Terms. Continued use after an update means you accept it.
10. Disclaimer and limitation of liability
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential loss, for loss of data or profit, or for acts and omissions of other members. Our total liability for any claim is limited to the amount you paid us for the plan in the 3 months before the claim arose.
11. Indemnity
You agree to compensate us for loss arising from your breach of these Terms or misuse of the Service.
12. Termination
You may stop using the Service and ask us to delete your account at any time. We may suspend or end your access for breach of these Terms. Clauses that by their nature should survive (for example 6, 10, 11 and 13) will continue.
13. Governing law and disputes
These Terms are governed by the laws of India. Courts at Navi Mumbai, Maharashtra, India have exclusive jurisdiction, subject to any mandatory consumer rights you have.
